Under California law, an employer shall not employ a non-exempt employee for a work period of more than five (5) hours a day without providing the employee with a duty-free meal break of not less than thirty (30) minutes, except that if the total work period per day of the employee is no more than six (6) hours, the meal break may be waived by mutual consent of both the employer and employee.
In addition, an employer shall not employ a non-exempt employee for a work period of more than ten (10) hours per day without providing the employee with a second meal break of not less than thirty (30) minutes, unless waived under certain conditions.
